Food Safety Law Implementation Regulations Review Draft: Establishing a Food Safety Inspector System

China News, October 20th, in order to clarify the obligations and responsibilities of food producers and operators, and strengthen food safety supervision and management, the General Administration of Food and Drugs drafted the "Regulations on the Implementation of the Food Safety Law of the People's Republic of China (Revised Draft for Approval)". At present, the regulations are soliciting opinions.

The regulations pointed out that a unified and authoritative food safety supervision system should be established to strengthen the responsibility of local governments for implementing the “four-plus-two” responsibility. Local people's governments at or above the county level shall assume responsibility for local management of food safety in their own administrative areas, establish a unified and authoritative food safety supervision system, strengthen food safety control systems and governance capacity, and ensure food safety regulatory agencies, personnel, funds, technical support, etc. In place, it is responsible for the regional food safety risks and major food safety accidents that have occurred in accordance with law.

Regulations specify the establishment of a professional team of food safety inspectors. The State establishes a system of food safety inspectors, and the food and drug supervision department establishes a team of full-time food safety inspectors, focusing on the implementation of good operating practices, hazard analysis and key control point systems for food production and operation enterprises above designated size and high-risk food production and operation enterprises. On-site inspections and daily supervision and inspection in accordance with relevant regulations.

The regulations point out that the strengthening of food safety supervision and management capabilities. The food and drug regulatory department of the State Council shall, in conjunction with relevant departments of the State Council, formulate standards for the construction of food safety supervision and management capabilities, and clarify the capacity building requirements for food and drug regulatory agencies, personnel, facilities and equipment at all levels. In addition, the responsibilities of the State Council’s Food Safety Committee and its offices have been refined.

It is reported that the deadline for the solicitation of opinions for this regulation is November 19 this year.
